SMS Terms & Conditions

1. Program Description

The DM18 Marketing SMS Alerts program allows subscribers to receive text messages from DM18 Marketing Digital to their mobile devices. This service includes:

• Marketing Messages: Promotional offers, special discounts, exclusive deals, product announcements, and marketing content
• Transactional Messages: Order confirmations, delivery updates, account notifications, and service-related communications
• Informational Messages: Company updates, event notifications, and relevant business information

2. Opt-In Process and Consent

To participate in this program, you must:

1. Be at least 18 years of age or older
2. Provide your mobile phone number
3. Provide your email address
4. Provide express written consent by checking the consent checkbox on our opt-in form
5. Receive and confirm a welcome message to complete enrollment (double opt-in)

Consent is not a condition of purchase. You can make purchases or use our services without subscribing to SMS messages. Alternative methods of contact are available.

By opting in, you expressly authorize DM18 Marketing Digital to send recurring marketing and transactional text messages to the mobile phone number you provided using an automatic telephone dialing system or other automated technology.

3. Message Frequency

Message frequency varies based on your activity and our promotional calendar:

• Marketing messages: Up to 10 messages per month
• Transactional messages: Sent as needed based on your activity
• Actual frequency may be higher or lower depending on ongoing promotions, events, and user interactions

You may receive multiple messages in a day during special promotional periods.

4. Cost and Charges

Message and data rates may apply. DM18 Marketing Digital does not charge you for receiving text messages from our program. However:

• Your mobile carrier's standard messaging and data rates apply
• Contact your mobile carrier for information about your messaging plan and rates
• Message and data charges are your responsibility
• We are not liable for any charges incurred by receiving messages

5. How to Opt-Out (Unsubscribe)

You can opt-out of the program at any time by texting any of the following keywords to the number from which you receive messages:

• STOP
• UNSUBSCRIBE
• CANCEL
• END
• QUIT

After you send an opt-out keyword, you will receive one final confirmation message stating that you have been unsubscribed. No further messages will be sent unless you opt back in.

Opt-out confirmation message: "You've been unsubscribed from DM18 Marketing messages. No more messages will be sent. Reply START to resubscribe."

• T-Mobile is not liable for delayed or undelivered messages

DM18 Marketing Digital is not responsible for:

• Carrier network issues or outages
• Delayed or undelivered messages
• Device compatibility issues
• Messages filtered by carrier spam protection

9. User Obligations

By participating in this program, you agree to:

• Provide accurate and current contact information
• Notify us if your phone number changes
• Not use the service for any unlawful purpose
• Not attempt to abuse, spam, or disrupt the service
• Comply with all applicable laws and regulations

10. Privacy and Data Use

Your privacy is important to us. Information collected through this program is governed by our Privacy Policy. By opting in, you consent to the collection and use of your information as described in our Privacy Policy.

12. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

12.1 Informal Dispute Resolution

Before filing a formal claim, you agree to contact us at supportdm18marketing@camburatomico.com to attempt to resolve any dispute informally. We will attempt to resolve the dispute within 30 days of receiving notice.

12.2 Binding Arbitration

If we cannot resolve a dispute informally, you agree that any claim or dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

Arbitration terms:

• The arbitration will be conducted by a single arbitrator
• The arbitrator's decision will be final and binding
• Arbitration will take place in a location convenient to you or remotely
• Each party will bear their own costs and fees

12.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration. • Abusive or fraudulent behavior
• Providing false or misleading information

We will make reasonable efforts to notify you before terminating your participation, unless immediate termination is required.

15. No Purchase Necessary

Consent to receive SMS messages is not a condition of purchase. You are not required to subscribe to SMS messages to purchase goods or services from DM18 Marketing Digital. Alternative methods of communication and purchase are available.

16. Age Restriction

You must be at least 18 years of age to participate in this SMS program. If you are under 18, you may not opt-in without parental or guardian consent. By opting in, you represent and warrant that you are at least 18 years old.

17. Third-Party Services

We use third-party service providers to facilitate SMS delivery and manage the program. These providers are contractually obligated to protect your information and use it only for providing services to us. We are not responsible for the practices of third-party service providers beyond our control.

20. Severability
